Wamatek Terms of Service

1. Introduction

Wamatek provides services through which users can:

  1. Sell certain consumer electronic products (the "Products") by receiving an offer from Wamatek and completing a transaction (β€œTrade-In”).
  2. Buy Products from Wamatek (β€œPurchase”).

By creating an account or using the Wamatek website, you agree to these Terms of Service, which may be updated periodically. Continued use of the services after changes are posted constitutes acceptance of the new terms. Wamatek reserves the right to terminate or suspend access to its services at its sole discretion.


2. About These Terms

These Terms govern:

  • Any offer you receive to sell your Product to or through Wamatek.
  • Any Product you purchase from Wamatek.
  • Your use of Wamatek’s website and services.

Any supplemental terms or policies accompanying specific transactions collectively form an agreement (β€œAgreement”) between you and Wamatek.


3. Requirements for Trade-In and Purchase

To complete a Trade-In or Purchase, you must:

  • Create an account (Trade-In only).
  • Provide accurate and up-to-date personal and transaction details.
  • Comply with all applicable laws and regulations.
  • Transact on your own behalf (not for others).
  • Be at least 18 years old with legal capacity to enter agreements.

For a Trade-In, you must provide a valid email address, postal address, and name. For a Purchase, additional billing information, such as a valid credit card, is required. Wamatek does not store your credit card information.

Failure to provide accurate information may result in misapplied payments or compliance with unclaimed property laws.


4. Trade-In and Purchase Transactions

4.1 Trade-In Transactions

  • Offers are based on Product model, functionality, and condition.
  • Offers expire after 30 days unless otherwise stated.
  • Products must match the description provided or may be subject to revised offers.
  • Once accepted, the Trade-In process is final, and ownership transfers to Wamatek.

4.2 Purchase Transactions

  • Your credit card is charged at the time of purchase.
  • Sales tax applies based on shipping destination.
  • Free standard shipping is available; expedited shipping incurs an extra fee.
  • Store pickup is available at 9701 Valley View Rd, Eden Prairie, MN 55344.

5. Returns & Warranty

  • Store purchases: 7-day return policy.
  • Online purchases: 30-day return policy.
  • Defective items: Full refund to the original payment method.
  • Other returns: May be subject to a restocking fee of up to 25%.
  • Warranty: Most purchases qualify for a 90-day repair warranty, with select products eligible for extended warranties.
  • International Returns: Customers outside the U.S. must arrange their own return shipping.

6. Product Eligibility

Wamatek determines which Products are eligible for Trade-In or Purchase. Certain Products may become ineligible without prior notice. However, offers already accepted remain valid.

Trade-In Products must:

  • Be owned by you, free of liens or encumbrances.
  • Be capable of activation unless classified as "Broken."
  • Comply with all applicable laws and not be counterfeit, stolen, or fraudulent.

7. Product Inspection & Valuation

  • Products must be received within 30 days of offer acceptance.
  • If the received Product does not match the provided description, Wamatek may issue a revised offer.
  • If you reject a revised offer, Wamatek will return the Product to you.

8. Data Removal & Security

Before sending a Product to Wamatek, you must remove all personal data. Wamatek attempts to erase data but does not guarantee complete removal. By submitting a Product, you release Wamatek from liability related to any data left on the device.


9. Risk of Loss & Title Transfer

  • You are responsible for the Product until it is received by Wamatek.
  • Wamatek assumes risk of loss upon receipt but transfers it back to you if the Product is returned.
  • Title to a Product transfers to Wamatek once a Trade-In is accepted.

10. Product Pricing & Availability

  • Prices are subject to change based on market conditions.
  • Wamatek does not price match or offer post-purchase price adjustments.
  • Orders are confirmed upon acceptance by Wamatek; availability is not guaranteed.
  • Bulk purchases are limited to three (3) Products per transaction unless pre-approved.

11. Import & Export Compliance

Users must comply with all U.S. and international trade laws. You may not submit any Products restricted by U.S. trade sanctions or related regulations.


12. Accuracy of Information

While Wamatek strives to ensure all information is accurate, errors may occur. Wamatek reserves the right to:

  • Correct errors before completing a transaction.
  • Cancel transactions affected by inaccuracies.

13. Electronic Notices & Transactions

By using Wamatek’s services, you consent to receiving electronic communications, including transaction confirmations and policy updates. You are responsible for keeping your email address accurate and ensuring Wamatek’s emails are not blocked by spam filters.


14. Disclaimer of Warranties & Liability

WAMATEK PROVIDES ALL SERVICES AND PRODUCTS "AS IS" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, Wamatek and its affiliates:

  • Disclaim all implied warranties, including fitness for a particular purpose.
  • Are not liable for indirect, incidental, or consequential damages exceeding the greater of $100 or the amount you paid.

15. Indemnification

You agree to indemnify Wamatek from any claims arising from:

  • Misrepresentation of a Product’s condition.
  • Violation of these Terms.
  • Any legal action related to your use of Wamatek’s services.

16. Modifications & Termination

Wamatek may modify these Terms at any time. Continued use of the services after updates signifies acceptance. If you do not agree with changes, you may discontinue using Wamatek’s services.


17. Governing Law & Dispute Resolution

These Terms are governed by the laws of Minnesota, USA. Disputes must be resolved in Minnesota state or federal courts.
